This Privacy Policy applies to customers residing in Switzerland. We process personal data in full compliance with the revised Swiss Federal Act on Data Protection (FADP / nDSG - Schweizerisches Datenschutzgesetz) effective since September 1, 2023.

2. CATEGORIES OF PERSONAL DATA COLLECTED

  • (1) Account & Contact Information: Name, delivery address in Switzerland, billing address, email, phone number, account password.
  • (2) xBloom App Recipe Parameters (Quick Mode & Get Created Mode): Grind Size, Water Temperature, Ground:Water ratio, Pour Numbers, Water Volume per pour, Pour Pattern, Pauses, and Vibration settings stored to execute machine brewing.
  • (3) Device Diagnostics & Machine Pairing: Machine serial number, firmware version, RFID pod scanner logs, error logs, and Wi-Fi pairing details.
  • (4) Cross-Border Logistics & Customs Data (DAP Terms): Data required to execute international transport from our EU warehouse network to Switzerland, perform Swiss import customs clearance, and compute Swiss Import VAT (8.1%) / postal administration fees.

3. CROSS-BORDER DATA TRANSFERS OUTSIDE SWITZERLAND

Where personal data is transferred outside Switzerland (e.g. cloud infrastructure in the EU or USA), we enforce an adequate level of data protection under Art. 16 et seq. Swiss nDSG:

  • (1) Transfers to states listed by the Swiss Federal Council as providing adequate data protection (e.g. EU member states).
  • (2) Standard Contractual Clauses (SCCs) recognized by the Swiss Federal Data Protection and Information Commissioner (FDPIC / EDÖB).
  • (3) Transfers executed under the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

4. STATUTORY RIGHTS & SWISS SUPERVISORY AUTHORITY

Under Articles 25 to 29 of the revised Swiss nDSG, you hold statutory rights including Information/Access (Auskunftsrecht), Data Release/Portability, Correction, and Erasure. You also have the right to lodge a complaint with the competent Swiss authority:

5. DATA RETENTION SCHEDULES

Commercial records and tax-related transaction documents are stored for 10 years in compliance with the Swiss Code of Obligations (OR).
